These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Shree Saibaba Charitable Trust, a charitable trust registered with the Government of Gujarat, Gujarat, India (Registration No. E-8462) ("the Trust", "Organization", "we", "us", or "our").

These Terms govern your access to and use of the website operated by the Trust (the "Website"), including all information, text, images, and services made available through it.

By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Website immediately.

1. About the Organization

Shree Saibaba Charitable Trust is a charitable trust registered with the Government of Gujarat, serving the Rajkot community since 11 September 2008. Our activities include mass weddings (Samuh Lagna), festival care, elderly welfare, disaster relief, and related seva programs.

The Website is an informational platform. It describes our work and provides a voluntary contact channel. It does not, by itself, constitute a solicitation for securities, a commercial marketplace, or a government service portal.

2. Eligibility and Capacity

You must be at least 18 years of age, or use the Website under supervision of a parent or lawful guardian, to submit the contact form or otherwise provide personal data.

By using the Website, you represent that you have the legal capacity to enter into these Terms under applicable Indian law.

While we endeavour to present information that reflects our work in good faith, you must not treat any statement, statistic, narrative, photograph caption, or description on the Website as a certified, audited, or legally binding representation.

Nothing on the Website constitutes legal, medical, financial, or tax advice. You should seek independent professional advice before relying on Website content for important decisions, including tax treatment of donations under the Income Tax Act, 1961.

4.1 Approximate numbers, dates, and descriptions

Unless we expressly state otherwise in writing, all numerical information displayed on the Website-including but not limited to years of service, counts of beneficiaries, weddings supported, program totals, rupee amounts, percentages, timelines, registration references, and similar figures-is intended as an approximate illustration of our seva and impact.

Such figures are based on internal records, estimates, rounding, or summaries prepared for public communication. They are published in good faith and are broadly true in substance, yet they may not be exact, complete, or current at the moment you view the page.

Dates (including founding dates, event dates, and "last updated" references on non-legal pages), names of programs, and descriptive text may likewise be approximate or subject to change without notice as our field work evolves.

4.2 No warranty of accuracy; limitation for legal reliance

To the fullest extent permitted by applicable law, we make no representation or warranty that any number, date, map, translation, image, video, testimonial, or other Website content is accurate, complete, error-free, or fit for use in litigation, regulatory filings, tax assessments, academic citation, journalism, due diligence, or any other formal proceeding.

You agree not to rely on Website content as the sole or primary basis for legal, financial, or governmental action against the Trust or any trustee, volunteer, or affiliate. For verified information-including registration particulars, donation receipts, or formal statements-please contact us directly using the details in Section 18.

Any discrepancy between Website content and official trust records shall be resolved in favour of the official record maintained by the Trust, unless and until we publish a written correction.

5. Intellectual Property Rights

Unless otherwise stated, all content on the Website-including text, photographs, graphics, logos, layout, and design-is owned by or licensed to the Trust and protected under applicable Indian copyright, trademark, and other intellectual property laws.

You may view and share links to public pages for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, or exploit Website content for commercial purposes without our prior written consent.

Unauthorized use may result in civil or criminal remedies under applicable law.

6. Contact Form and Communications

The Website offers an optional online contact form. When you submit the form, you voluntarily provide the information requested. Processing of that information is described in our Privacy Policy.

You agree that information you submit is truthful to the best of your knowledge. You are responsible for the content of your message.

Submitting the form does not create a trustee-beneficiary relationship, employment relationship, or guarantee that we will respond within a particular timeframe, although we aim to respond to genuine inquiries reasonably promptly.

7. Donations and Financial Contributions

The Website does not currently process online payments or collect payment card information. Donation instructions, if any, are provided offline (for example, by phone or email) and are subject to separate verification by the Trust.

Any voluntary donation you make to support the Trust's charitable objectives is made without coercion and only if you are legally authorized to use your chosen payment method.

Donations to registered charitable trusts in India may have tax implications. Receipts, exemptions, or deductions under Section 80G or other provisions of the Income Tax Act, 1961 apply only where the Trust is duly registered and qualified for the relevant benefit and a valid receipt is issued in accordance with law.

Unless otherwise required by applicable law or expressly agreed in writing, donations are generally non-refundable once applied to charitable purposes.

8. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect and process personal data, including contact form submissions, Google Analytics, and Vercel Web Analytics.

Without limiting the foregoing, Section 4 (Approximate Figures) applies to all non-legal informational content on the Website. Legal documents posted on the Website (such as this Terms page and our Privacy Policy) describe our policies as of their stated "Last Updated" date; they do not by themselves amend trust deeds, registration certificates, or tax exemptions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Trust and its trustees, officers, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or other intangible losses, arising out of or related to your use of (or inability to use) the Website.

To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of these Terms or the Website shall not exceed INR 1,000 (Indian Rupees One Thousand Only), except where liability cannot be limited under applicable law (including liability for fraud or wilful misconduct).

Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

12. Indemnity

You agree to indemnify and hold harmless the Trust and its trustees, volunteers, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of applicable law, except to the extent caused by our wilful misconduct.

13. Intermediary Status (IT Act)

For purposes of the Information Technology Act, 2000 and rules made thereunder, the Trust operates the Website as an intermediary publishing information at the direction of users (for example, contact form submissions). We act in good faith to review communications sent to us and to remove or block manifestly unlawful content where we become aware of it.

Nothing in this section limits your rights under applicable data protection law.

14. Modifications to Terms

We may revise these Terms at any time. Revised Terms take effect when posted on this page with an updated "Last Updated" date.

Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms, to the extent permitted by law.

15. Force Majeure

We shall not be liable for delay or failure to perform obligations resulting from events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, government actions, power or Internet failures, or failures of third-party hosting or analytics providers.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Subject to applicable law, courts at Rajkot, Gujarat shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Website.
